Labourlink BV Privacy statement

As of 25 May 2018, the General Data Protection Regulation (GDPR) shall apply. This means that from
now on, the same privacy legislation applies throughout the European Union (EU). The GDPR
ensures, among other things, that your data is processed even more carefully. Organizations,
including ours, have to provide more clarity as to why we collect your personal data, for what we are
using it and how long the data will be stored. We must also provide candidates with access to the
stored data, if they so wish. The moment you choose to provide us with information voluntarily, for
example by applying for a position with us, we will use this information in accordance with our
Privacy statement.

Why do we collect your personal data?

The reason we collect and register the data has to do with our services in the form of temporary
employment, outsourcing, payroll and recruitment and selection. Specifically, we will use the data in:

  • Making an offer and/or providing information about the services and other activities, and
    being able to tailor it better to your wishes and qualities, this is done by our employees;
  • Identifying your suitability and availability in order to be able to assess this in connection
    with mediation into fixed or temporary work or an assignment;
  • Engaging and maintaining an employee or personnel/mediation relationship with you, and to
    do the relevant administration for this;
  • Enabling us to determine your identity;
  • Enabling us to comply with our obligations with regard to our reintegration obligations, and
    to help people at a great(er) distance to the labour market, to work;
  • Enabling us to receive an order confirmation, and to draw up a subsequent agreement. And,
    of course, to comply with what has been agreed to;
  • The data is also used to stimulate your personal development and employability through
    training, education and testing;
  • For management purposes such as management information, providing internal inspections,
    operational safety and performing audits and accounting inspections, if we have entered into
    an employee or personnel/mediation relationship with you;
  • To do the (deductions for) income tax and payroll and pension administration (including
    wage declarations with the tax authorities).

What information do we collect from you?

We only process the personal data necessary for our service; part of this data is required to make use
of our services. Additional information may be desirable in order to better tailor the service to your
wishes and qualities or to meet more specific questions or obligations from clients. In addition, it
offers us the opportunity to test whether you as a candidate fit in with the job profile and the job
requirements. And of course, to be able to offer you the correct salary scale.
You are personally responsible for supplying and keeping the correct details up-to-date.

To register, we will collect the following data (job seeker or candidate):

  • Name and address, email address and other contact details;
  • Birth data, age, gender;
  • Curriculum Vitae (CV), information about training, internship and work experience
    data on availability and leave;
  • Other data that may be important in the assessment of the suitability of the candidate, for
    example references and certificates;
  • Contact history;
  • Passport photo and video (introduction) – on a voluntary basis;
  • Social security number. This only when you apply for a role where a safety assessment in the
    form of a Declaration of No Objection (VGB) is necessary1.

If you start working for Labourlink (seconded, (temporary) employee and self-employed) or already
work for us, we will register the following additional information:

  • Nationality, Social security number, proof of ID and possible work permit;
  • Other information related to the personnel, salary and absenteeism registration.

Labourlink only records the personal data needed to fulfil its legal obligations (only when permission
is given for this). We will not process any privacy sensitive information regarding race, religion or
belief, political opinion, health, sexual life, trade union membership, criminal data and/or personal
data about unlawful or obstructive behaviour.

Application / Registration

If you apply with us or register via our website, we collect certain non-identifiable information about
the users of the website, such as the Internet Protocol (IP) address of your computer, the IP address
of your Internet Service Provider, the date and time of access to the website, the internet address of
the website from where you were directly linked to our website, the operating system you use, the
parts of the website that you visit, the pages of the website you have visited and the information you
have viewed, information about the type of device you use for your visit to the site, and the
geographical location where you are. This technical information is used to manage the website and
system administrator, and to improve the website and its use. This technical data may be passed on
to third parties and can be permanently stored for future use.

Labourlink uses cookies and web statistics. We do this to see how visitors use our website. This
information helps us to improve the site. Cookies are small pieces of information that are stored on
our computer. During a next visit to our website, these small pieces of information are recognized
which makes your visit easier.

With whom can we share your personal data?

Labourlink may share personal data with its clients, subcontractors (such as data processors) who
provide services or carry out assignments on behalf of Labourlink, suppliers, government bodies and
other business relations. In some cases, we may be required to share your information. For example,
by an injunction or a court order (such as an attachment of earnings).

The provision of the personal data takes place on the basis of a legitimate interest, legal obligation
and/or to execute the agreement in accordance with the objectives as mentioned under ‘Why do we
collect your personal data?’. Your data may be transferred outside the Netherlands. Labourlink has
taken the necessary measures to ensure that the transmitted personal data is adequately protected.

If you work/have worked for Labourlink

We will keep your mediation data up to two years after termination of employment. Some data will
be kept longer in relation to claims, audits and tax obligations, for example. If you no longer want to
be mediated, please let us know. In that case, you will no longer be approached and mediated by us.
For 2 years after you have left service, your data will be archived in a protected environment. Your
personal data will then only be available to us under strict conditions, in accordance with the
applicable objectives and periods.

Personal details of business relations2

Labourlink processes the personal data of subjects who work for companies with whom we maintain
a business relationship. We register this for the following reasons:

To provide information about the services and other activities;

  • To be able to maintain the business relationship;
  • To enter into an assignment agreement and to be able to comply with and monitor it.
  • The information we need for this is the following personal data of business relations:
  • Name, contact details and function of the contacts.

The personal data of the business relations can be provided to achieve the objectives of the business
relationship or for the benefit of the mediation. The data is passed on to applicants or candidates,
(business) partners and subcontractors (data processing) who provide services on our behalf. In the
event of an injunction or court order, we may share the data.

Rights

You have the right to inspect and change the personal data registered about you. If you no longer
wish to make use our services, you may submit a request for the removal of all your personal data.

Protection

Labourlink takes the privacy of its relations very seriously. We therefore make every effort to ensure
that your data is not used unlawfully. We do this by optimally protecting your data through physical,
administrative, organizational and technical measures. You can only access your data if you are
authorized, your data will only be shared with those who need them. It has also been agreed with
the external parties that your data will be treated with respect and optimally secured. External
parties are the relations that provide services or carry out assignments on our behalf (see footnote
2).

Improper distribution of your data or a data breach

If you suspect that your data has been distributed improperly or you believe there is a data breach,
please contact us directly at admin@labourlink.nl. Please mention your name, phone number and a
description of the situation.

Changes

Since the legislation was recently introduced, it is expected that changes will be made. We therefore
reserve the right to make any changes, additions or amendments to the Privacy Statement. The most
up-to-date Privacy Statement can be viewed at all times on the Labourlink website
(www.labourlink.nl).

Other provisions

Dutch law applies to the provisions of this privacy statement and any resulting disputes.
